2. According to petitioner, she was appointed as Assistant Teacher in a School run by Basic School Education Board on 29.09.2005, and thereafter by virtue of Section 58 of Uttarakhand School Education Act, status of Government servant was conferred upon her.
3. Petitioner thereafter appointed as Assistant Teacher (LT) Grade on the recommendation of Selection Committee, and she joined duties as Assistant Teacher (LT) Grade on 12.10.2007.
4. According to petitioner, her services rendered in the School run by Basic School Education Board were added to the services rendered as Assistant Teacher (LT) Grade on 11.06.2025; however, she is being treated as member of ‘New Pension Scheme’.
5. In this writ petition, petitioner has sought the following relief:
“Issue a writ in the nature of mandamus directing the respondents to treat the petitioner as covered under old pension scheme (OPS) as the petitioner was initially appointed as Assistant Teacher (Basic) on 29.9.2005 pursuant
2026:UHC:2825 to advertisement dated 15.9.2005 and her services in Basic Education has been added to the services in Secondary Education vide order dated 11.06.2005 (Annexure-8 Page 34).”

Learned counsel for the petitioner submits that other similarly situate persons have been given benefit of ‘Old Pension Scheme’, therefore, petitioner is also entitled to similar benefit.
7. Learned State Counsel submits that if petitioner has any grievance, then she could have approached the competent authority by making representation.
8. The writ petition is, accordingly, disposed of by permitting the petitioner to make representation. If she makes representation claiming benefit of ‘Old Pension Scheme’ within two weeks from today, decision thereupon shall be taken by competent authority, as per law, within four months thereafter.
