The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.397/2026, registered at Police Station Champa, District Janjgir-Champa (C.G.) for alleged commission of offence KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.08.24 14:02:01 +0530
2 punishable under Sections 309 (6), 324 (2), 119 (1) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’).
2. As per the case of the prosecution, the applicant and co-accused stopped and assaulted the complainant and his companions at Hathnewara turn, threatened them and forcibly took Rs.1,500/- from the complainant. Thereafter, FIR was registered. Hence, the bail application.

Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case. He further submits that the applicant, along with his friends, runs a Gaushala in the name of Gaushala DhamHathnewara, by forming a committee in village Hathnewara, and takes care of cows injured in road accidents and sick cows by bringing them to his Gaushala for their treatment and maintenance. According to his daily routine, the applicant along with his friends, on 20.07.2026, had gone towards HathnewaraMor, National Highway, near the bridge over Hasdeo River, to treat injured animals. At about 12:00 midnight, journalist Saurabh Tiwari, his friend Suraj Kumar Sahu, and other persons, while driving car No. CG 11 BE 5925 in an intoxicated condition, at high speed and negligently, hit a small calf at Hathnewara turn. The calf sustained injuries and their car went off the road and was damaged. The Gau Seva Vahini and persons present around the shop took the injured calf to the roadside and treated it. Journalist Saurabh Tiwari and his friends were advised to drive the vehicle slowly. Then Saurabh Tiwari
3 said: "I am a journalist of the newspaper. You people are creating nuisance with me. You leave the cattle loose in the village. Accidents occured because of leaving the cattle loose today. My car has also been damaged. You people make my car and create a commotion on the road." Saurabh Tiwari further started saying that he would lodge a report against the T.I. of Police Station Champa, Ashok Vaishnav, and S.I. Vijay Pandey, by calling them on his phone, and threatened that he would lodge an FIR against them. The police personnel present there explained the matter to Saurabh Tiwari and his friends. At the same time, the applicant reached there along with his friends, who were previously acquainted with Saurabh Tiwari and the applicant also explained the matter to him and tried to persuade him to go home. However, on the second day, i.e. 21.07.2026, journalist Saurabh Tiwari, through his friend Suraj Kumar Sahu, lodged a false report against the applicant alleging looting of Rs.1,500/- and damaging his car against the applicant. The applicant came to know about this on 28.07.2026, when police personnel came to the applicant's house.
Neither the applicant nor his friends committed any loot/robbery with Saurabh Tiwari and Suraj Kumar Sahu, nor was any money demanded from them. They have lodged a false report against the applicant and his friends in order to create fear among the general public by showing the influence of being journalists. Hence he prays to enlarge the applicant on anticipatory bail. 4

On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that the charge sheet has not been filed in the present matter, the investigation is at the initial stage and the remaining accused persons are absconding therefore, the anticipatory bail application of the applicant deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the submissions of learned counsel for the parties and the fact that the charge sheet has not been filed in the present matter, the investigation is at the initial stage, the remaining accused persons are absconding, and prima facie the involvement of the applicant in the commission of the offence is apparent and it appears that the applicant has committed the offence of robbery with the complainant, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant - Bhupendra Singh, involved in Crime No.397/2026, registered at Police Station Champa, District Janjgir-Champa (C.G.) for alleged commission of offence punishable under Sections 309 (6), 324 (2), 119 (1) & 3(5) of the BNS, is rejected.
