Learned advocate appearing for the petitioner submits that the petitioner is in custody for 85 days, complaint has already been submitted before the jurisdictional court and there has been alleged recovery of 11.975 kgs. of ganja from the present petitioner.
Learned advocate for the Air Customs Authority opposes the prayer for bail.
I have taken into account the seizure as well as the place of seizure. The principle referred to in Barnali Bag Vs. Union of India (Special Leave Petition (Crl.) No.3641 of 2026) is applicable to the facts of the present case, as such, petitioner is released on bail.
Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Ms. Deepa shall be released on bail
2 upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 8th Court, Barasat, 24 Parganas (North). If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of 24 Parganas (North) without prior permission of the learned special court. Petitioner will inform her address where she would be residing prior to her release and make herself available for being inspected by the investigating officer or any officer assigned by the Principal Commissioner, Air Customs Authority.
Thus, CRM(NDPS) 1529 of 2026 is allowed.
