Showkat Ali @ Bhagu … … Petitioner(s) Mr. Satadru Lahiri Mr. Jyotirmoy Talukdar … for the Petitioner(s) Mr. Sagar Saha Ms. Nayana Mukhopadhyay … for the State-respondent(s) Learned advocate for the petitioner submits that although the recovery in the present case is approximately 41 kg of brown sugar but there has been no recovery from the present petitioner and the petitioner has been implicated only on the basis of statement of a co-accused. Learned advocate for the State was earlier directed to ensure regarding the complicity as well as antecedents in regard to money trail and/or CDR of the present petitioner and other accused persons. State has submitted a report which reflects that there are two earlier cases under the BNS and Arms Act. So far as the present case is concerned, charge- sheet has been submitted; no CDR/SDR is reflected from the 2 report and no specific materials are appearing presently except the statement of the accused. Having considered the same, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Md. Showkat Ali @ Bhagu shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), 4th Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of Malda without prior permission of the learned Special Court/trial court. Accordingly, CRM (NDPS) 1319 of 2026 is allowed. Report and the Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
