D/L5 30.07.2026 Bpg. C.R.M. (M) 1452 of 2026 In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Nandigram Police Station Case No.231 of 2025 dated 17.04.2025 under Sections 109/103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and charge-sheet submitted under Sections 109/103(1)/302(2)/62/3(5) of the Bharatiya Nyaya Sanhita, 2023; Samim Sk. Versus The State of West Bengal Ms. Jeenia Rudra. ...for the petitioner. Mr. Krishnendu Bhattacharya Ms. Priti Kar Bagchi. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is renewing his prayer for bail as he is in custody for 1 year 3 months. There is no possibility of the trial commencing in near future, as such, the petitioner may be released on bail on any stringent conditions. Learned advocate for the State opposes the prayer for bail and submits that a police driver was run over intentionally when he tried to intercept a vehicle of cattles being illegally lifted for sale. Having regard to the gruesome manner in which the offence was committed, I am inclined to release the petitioner on bail at this stage. Accordingly, the prayer for bail of the petitioner in 2 CRM(M)1452 of 2026 is rejected. Learned trial court is directed to expedite the proceedings so that at an early date the stage of charges should be overcome. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
