Learned advocate appearing for the petitioner submits that the petitioner is in custody for 99 days (about 3½ months). There was no recovery from the petitioner although the subject matter of the case involves recovery of 165 ampules of Buprenorphine. Learned advocate appearing for the State opposes the prayer for bail and submits that some of the accused persons have been absconding. In view of the same, since the trial would exhaust the process of law, the State is directed to split up the trial and proceed with the same. Having considered the fact that no recovery was made from the present petitioner and there is no antecedent as reported by the State, I am inclined to release the petitioner
2 on bail. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Ashok Ghosh shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Dakshin Dinajpur without prior permission of the learned special court. Thus, CRM(NDPS) 1509 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
