29.07.2026 Serial no. 39 [G.S.D] CRM (NDPS) 1235 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with PTN Case No. 1935 of 2025 arising out of Kaliachak PS Case No. 2021 of 2025 dated 10.12.2025 u/s 21(c)/27A/29 of the NDPS Act. -And- In the matter of : Habibur Rahaman … … Petitioner(s) Md. Wasim Akram Ms. S. Parveen … for the Petitioner(s) Mr. Goutam Dey … for the State-respondent(s) Learned advocate for the petitioner submits that the similarly placed accused person has been granted bail in CRM (NDPS) 1259 of 2026. Learned advocate for the State opposes the prayer for bail but is unable to refute the contention that the petitioner is similarly placed as the other accused who has been granted bail. Having considered that other accused person [Yasir Khan] has been granted bail in CRM (NDPS) 1259 of 2026, I am inclined to grant bail to the present petitioner on the same terms and conditions as was granted to Yasir Khan in CRM (NDPS) 1259 of 2026. Hence, the prayer for bail of the petitioner [Habibur Rahaman] is Allowed. 2 The learned trial court/Special court would release the petitioner on bail on the same terms and conditions as was imposed on Yasir Khan in CRM (NDPS) 1259 of 2026. Accordingly, CRM (NDPS) 1235 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
