JUSTICE H.S.GREWAL Present :- Mr. G.P.S. Ghuman, Advocate for the petitioner. Mr. Subhash Godara, Addl. AG, Punjab, for the respondent-State. ***** H.S.GREWAL, J.(Oral) 1. The present petition has been filed under Section 483 of BNSS, 2023 (erstwhile Section 439 Cr.P.C.) seeking regular bail to the petitioner in case FIR No.0162 dated 18.04.2026, registered under Sections 111, 3(5) of BNS, 2023 (erstwhile Section 34 IPC) and Section 25(6), 25(7)(i) of the Arms Act, 1959, at Police Station Derabassi, District S.A.S. The case of the prosecution is that on 18.04.2026, while conducting naka checking at Janetpur Cut, Dera Bassi, the police received secret information that Arman Singh, Akshay @ Prince, Chirag and Ravinder Singh @ Rahul, who were allegedly associated with the Goldy Dhillon gang, were travelling in a Honda Amaze car without number plate, SEEMA SHARMA 2026.07.18 16:06 I attest to the accuracy and authenticity of this order/judgment CRM-M No.33086 of 2026 -2- carrying illegal arms and ammunition to commit a crime. Acting on the information, the present FIR was registered. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he was not present at the time spot on 18.04.2026. It is further submitted that the petitioner was already in police custody prior to the alleged recovery, i.e 17.04.2026 thereby, casting doubt on the prosecution version. In support of his contentions, he relies upon the CCTV footage which was handed over to the Investigating Officer in the Court on the last date of hearing. He further submits that three live cartridges were allegedly recovered from the petitioner whereas, a country-made pistol was recovered from co-accused Ajay. He also submits that although, the petitioner is involved in one more case in which he has already been discharged. He further submits that the petitioner is in custody for the last 02 months and 17 days. He, therefore, prays for release of the petitioner on regular bail. 4. Learned State counsel has filed the custody certificate of the petitioner which is also taken on record. As per the custody certificate, the petitioner is in custody for the last 02 months and 17 days. He vehemently opposes the prayer for grant of bail to the petitioner. 5. I have heard the learned counsel for the parties and perused the record. 6. In view of the above submissions of learned counsel for the parties and keeping in view the facts that the petitioner is in custody for the last more than 02 months and 17 days and that the trial is likely to take a SEEMA SHARMA 2026.07.18 16:06 I attest to the accuracy and authenticity of this order/judgment CRM-M No.33086 of 2026 -3- long time to conclude, therefore, this Court deems it appropriate to grant the concession of regular bail to the petitioner during the pendency of the trial as the continuous detention of the petitioner would not serve the ends of justice. 7. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 8. However, it is made clear that in case the petitioner misuses the concession of bail, the State/complainant would be at liberty to seek cancellation of his bail.
