Petitioner has filed this writ petition, seeking following reliefs:- “10.1 The Hon’ble Court may call for records from the respondents. 10.2 The Hon’ble Court may direct the respondents to grant leave encashment and leave surrender to the petitioner in her capacity as a regular employee. 10.3 The Hon’ble Court may direct the respondent no. 3 and 4 to dispose off in time bound manner the representation dated 31.10.2025 of the petitioner as per the extent service rules with regard to leave encashment and leave surrender of a regular employee. 10.4 The Hon’ble Court may grant cost of petition to the petitioner. 10.5 The Hon’ble Court may grant any other relief as this Hon’ble Court may deem fit and proper in the nature and circumstances of the present case in the interest of justice.” 2. Learned counsel for petitioner submits that petitioner was regular employee and was working as Peon. After putting about 26 years of service and attaining the age of superannuation he got retired on 31.08.2021. However, along with retiral dues which has to be paid to petitioner, respondent authorities have not paid the amount due towards leave encashment for which petitioner has submitted a representation before respondent no. 4 but till date no decision has been taken on the representation submitted, hence direction be issued to respondent no. 4 to consider and take decision on pending representation at the earliest within a specified time frame. 3. Learned counsel for Respondent-State submits that in view of limited prayed made by learned counsel for petitioner, he is having no objection. 3 / 3 4. On due consideration of submission made by learned counsel for respective parties, I find it appropriate to dispose of this writ petition at this stage directing respondent no. 3 to consider and take decision on pending representation Annexure P-1 dated 30.10.2025, in accordance with law, expeditiously, preferably within a further period of two months from the date for receipt of order. 6.
