2. It transpires from the record that the applicants are in jail since
19.05.2026. Hence, the Court proceeds to consider and hear the bail application of the applicants with the assistance of the State counsel. 3. The applicants have preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of regular bail, as they have been arrested in connection with Crime No. 144/2026, registered at Police Station Pachpedi, District Bilaspur (CG) for the offence punishable under Sections 109, 296, 351(3), 115(2), 190, 191(2), 191(3) of BNS. 4. The prosecution story in brief, is that on 17.05.2026 at about 12:30 p.m., the complainant Prabhakar Marshal, along with Nimesh Rai and Dileshwari Marshal, was proceeding on a motorcycle carrying a loudspeaker and announcing in the community for women to attend the Dashgatra programme of his elder aunt. When they reached near Petrol Pump, Pachpedi, the accused Badal Jangde allegedly came from the opposite direction riding his motorcycle rashly and negligently and collided with their motorcycle, as a result of which all three fell down. When the complainant objected to driving slowly, Badal Jangde allegedly became enraged and abused him in filthy language and assaulted him with a belt. Thereafter, Vicky Jangde, Vikas Marshal and other accused persons allegedly arrived at the spot, abused the
3 complainant and threatened to kill him and assaulted him with lathis, sticks and an iron object.
Subsequently, Saroj Jangde and other persons allegedly joined them and, in furtherance of their common intention, abused and assaulted the complainant with a sharp object and bricks. The complainant sustained injuries on his back. When Nimesh Rai intervened to save him, he was also allegedly assaulted, resulting in injuries to his head, ear, lip and face, for which he was admitted to SIMS Hospital, Bilaspur and subsequently treated at Mekahara Hospital, Raipur. During investigation, on the basis of the memorandum statements of accused Badal Jangde and Saroj Jangde, the involvement of the other accused persons was disclosed. It is alleged that Badal Jangde assaulted with a piece of brick, Vikas Marshal with a screwdriver and Saroj Jangde with a belt, and one belt was seized from accused Saroj Jangde. The accused persons were arrested on 19.05.2026 and were sent to Central Jail, Bilaspur. The prosecution alleges that the accused persons, acting in furtherance of their common intention and with an intention to cause death, caused serious injuries to the victims. Hence, the bail application. 5. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has not been filed in the present case before the competent Court. He further submits that the applicants along with other co-accused persons,
4 abused and assaulted the complainant and Nimesh Rai by belt and bricks, on account of which, injured, Nimesh Rai sustained injured on his head, ear, lip and face, his parietal bone has been fractured and was admitted to SIMS Hospital, Bilaspur and subsequently treated at Mekahara Hospital, Raipur. He also submits that Badal Jangde assaulted the complainant with a piece of brick, whereas Saroj Jangde assaulted him with a belt. Therefore, the applicants are not entitled for grant of bail. 6. I have perused the material available on record. 7.
Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, though charge-sheet has not been filed in the present case, but considering the fact that the applicants, along with the co-accused persons, abused and assaulted the complainant and injured, Nimesh Rai with belts, bricks and other articles, causing serious injuries, the injured, Nimesh Rai sustained a fracture of the parietal bone, which is grievous in nature and dangerous to life, and for which he required treatment at SIMS Hospital, Bilaspur and subsequently at Mekahara Hospital, Raipur. The specific overt acts attributed to the accused persons, coupled with the seriousness of the injuries sustained by the injured, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, the bail application of applicants - Badal Jangde and
5 Saroj Jandge involved in Crime No. 144/2026, registered at Police Station Pachpedi, District Bilaspur (CG) for the offence punishable under Sections 109, 296, 351(3), 115(2), 190, 191(2), 191(3) of BNS., is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
