209 (3) IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH CRM-M No.35981 of 2026 Date of decision: 17.07.2026 Ravinder Singh @ Rahul …Petitioner Versus State of Punjab …Respondent CORAM: HON’BLE MR. JUSTICE H.S.GREWAL Present :- Mr. G.P.S. Ghuman, Advocate for the petitioner. Mr. Subhash Godara, Addl. AG, Punjab, for the respondent-State. ***** H.S.GREWAL, J.(Oral) 1. The present petition has been filed under Section 483 of BNSS, 2023 (erstwhile Section 439 Cr.P.C.) seeking regular bail to the petitioner in case FIR No.0162 dated 18.04.2026, registered under Sections 111, 3(5) of BNS, 2023 (erstwhile Section 34 IPC) and Section 25(6), 25(7)(i) of the Arms Act, 1959, at Police Station Derabassi, District S.A.S. Nagar Mohali. 2. The case of the prosecution is that on 18.04.2026, while conducting Naka checking at Janetpur Cut, Dera Bassi, the police received secret information that Arman Singh, Akshay @ Prince, Chirag and Ravinder Singh @ Rahul, who were allegedly associated with the Goldy Dhillon gang, were travelling in a Honda Amaze car without a number SEEMA SHARMA 2026.07.18 16:06 I attest to the accuracy and authenticity of this order/judgment CRM-M No.35981 of 2026 -2- plate, carrying illegal arms and ammunition to commit a crime. Acting on the information, the present FIR was registered. 3. Learned counsel for the petitioner submits that the petitioner is not involved in any other case and has falsely been implicated in this case. It is submitted that the petitioner is 22 years old. He also submits that no recovery has been effected from the petitioner and he was merely accompanying the co-accused, namely, Ajay from whom a country-made pistol was recovered. He further submits that the petitioner is in custody for the last 01 month and 30 days. He, therefore, prays for release of the petitioner on regular bail. 4. In compliance of the order dated 10.07.2026, learned State counsel has filed the affidavit of the SHO-cum-Investigating Officer, Police Station Derabassi, District SAS Nagar, which is taken on the record. He has also filed the custody certificate of the petitioner which is also taken on record. As per the custody certificate, the petitioner is in custody for the last 01 month and 30 days. He vehemently opposes the prayer for grant of bail to the petitioner. 5. I have heard the learned counsel for the parties and perused the record. 6. In view of the above submissions of learned counsel for the parties and keeping in view the facts that the petitioner is in custody for the last more than 01 month and 30 days and that the trial is likely to take a long time to conclude, therefore, this Court deems it appropriate to grant the concession of regular bail to the petitioner during the pendency of the SEEMA SHARMA 2026.07.18 16:06 I attest to the accuracy and authenticity of this order/judgment CRM-M No.35981 of 2026 -3- trial as the continuous detention of the petitioner would not serve the ends of justice. 7. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 8. However, it is made clear that in case the petitioner misuses the concession of bail, the State/complainant would be at liberty to seek cancellation of his bail.
