1. Heard Ms. S. Roy, the learned counsel for the applicant. 2. This appeal under Order 14 Rule 5 of the Code of Civil Procedure has been filed by the National Insurance Company Limited/applicant in connection with MAC Appeal No. 129/2026 praying for stay of execution of the impugned the judgment and award dated
Page No.# 3/3 29.12.2025 passed by the Motor Accident Claims Tribunal Goalpara in MAC Case No. 284/2022 whereby the applicant was directed to pay a compensation amount of Rs. 2,37,000/- along with interest at the rate of 7.5% per annum to the claimant. 3. Since the Insurance Company is ready to deposit 50% of the awarded amount as a condition of staying the execution of the impugned judgment and award, the notice to the respondent is hereby waived and this Interlocutory Application is allowed. 4.
The execution of the aforementioned award shall remain stayed during the pendency of connected MAC Appeal No. 129/2026 subject to the deposit of 50% of awarded amount by the National Insurance Company Limited/applicant before the Registry of this Court within six weeks from the date of this order. 5.
