The petitioner has filed this petition seeking following relief(s):- “10.1) That, this Hon'ble Court may kindly be pleased to call the entire record pertinent to case of petitioner. 10.2) That, this Hon'ble Court may kindly be pleased to issued writ/direction to set-aside the impugned recover order dated 25.11.2025 (Annexure P1) issued by the respondent No. 6 further challenging letter dated 23.12.2025 (Annexure P-2) issued by the respondent No. 5. -2- 10.3) Any other relief which this Hon'ble Court may deem fit and proper also kindly be granted to the petitioner, in the interest of justice.” 2. Learned counsel appearing for the petitioner would submit that the Chief Executive Officer, Janpad Panchayat Bilaigarh, District Sarangarh (C.G.) assessed the amount of recovery without holding any inquiry and recommended the Sub-Divisional Officers/competent authority to take an appropriate action. Mr. Kesharwani would further submit that the Chief Executive Officer, Janpad Panchayat Bilaigarh did not afford any opportunity to the petitioner while arriving at the figure mentioned in the order Annexure P/1 dated 25.11.2025. 3. On the other hand, Mr. Anadi Sharma, learned Panel Lawyer appearing for the State would oppose the submissions made by Mr. Kesharwani. He would submit that the Chief Executive Officer, Janpad Panchayat Bilaigarh after physical verification arrived at the figure and recommended the matter to the Sub-Divisional Officer (Revenue) to take appropriate action. He would contend that the petitioner may submit all relevant documents before the Sub-Divisional Officer and defence of the petitioner would be considered by the authority concerned. 4. Heard the learned counsel appearing for the parties and placed the documents on record. 5. Taking into consideration the submissions advanced by respective Advocates, this petition is disposed of reserving liberty in favour of the petitioner to file reply to show-cause notice issued by the Sub- 3 Divisional Officer dated 23.12.2025 along with all relevant documents. The Sub-Divisional Officer (Revenue) shall adjudicate the matter and take appropriate decision after affording due opportunity of hearing to the petitioner. 6.
