1. The petitioner has filed this petition seeking the following relief(s):-
“10.1 That, this Hon'ble Court may kindly be pleased to issue a writ of MANDAMUS and may kindly be pleased to quash the transfer order dated 12.09.2022. 10.2 That this Hon'ble court may kindly be pleased to direct the respondent No.2 decided the representation made by the petitioner. 10.3 That any other relief, which this Hon'ble Court may deem fit and proper together with cost of the petition.” NIRMALA RAO

Learned counsel appearing for the petitioner would submit that the petitioner, who was promoted to the post of Revenue Inspector in the Office of the Collector, Land Records/Diversion Office, Durg, was transferred to R.N. Circle, Dhamdha, Tehsil Dhamdha, District Durg vide order dated 12.9.2022. He would contend that the transfer of the petitioner was made contrary to the transfer policy. It is also submitted that an interim order was granted in favour of the petitioner on 20.9.2022, which is still in operation. He would further contend that, since the transfer was made in contravention of the transfer policy, the
order dated 12.9.2022 is bad in law.
3. On the other hand, learned counsel appearing for the State would oppose the submissions made by learned counsel for the petitioner.
4. I have heard learned counsel for the parties and perused the documents available on record.

Having considered the fact that the transfer order was issued in contravention of the transfer policy, the transfer order dated 12.9.2022, insofar as it pertains to the petitioner, is hereby quashed. The State authorities shall be at liberty to issue a fresh transfer order, if the exigencies of service so require.
6. With the aforesaid observation(s), this writ petition is disposed of.
