2. Learned counsel for the petitioner submits that he has filed an application under Section 89 of the Chhattisgarh Land Revenue code, 1959 (in short ‘Code of 1959’) (Annexure P/2) way back on 23.05.2025 before the Respondent No.3/SDO (Revenue), Bemetara, District Bemetara Chhattisgarh for correction of error in the revenue records.
Despite initiation of proceeding, till date, no final order has been passed and as such he has filed this petition with the limited relief that the Respondent No.3/SDO (Revenue) may be directed to consider and decide the application for correction of name in the revenue records in accordance with law within the stipulated period as fixed by this Court. 3. Learned State counsel has no objection to the limited prayer made by the petitioner and submits that if Courts directs, the Respondent No.3 will decide the application filed by the petitioner in an expeditious manner in accordance with law. 4. I have heard learned counsel for the parties and perused the records with utmost circumspection. 5. It appears that earlier the revenue records stood in the name of the petitioner in respect of the Khasra No.1497/2 admeasuring 0.040 hec. Situated at village Kobiya, District – Bemetara (C.G.) and subsequently, the petitioner came to know that the land in question had been recorded as Government land in the revenue records, and the name of the petitioner was not reflected therein. Being aggrieved, the petitioner has filed an application under
4 Section 89 of the Code of 1959 which is pending for consideration till date. 6. Considering the facts and circumstances of the case and considering the fact that the application has been filed by the petitioner way back on 23.05.2025, therefore, the Respondent No.3/SDO (Revenue) is directed to consider and decide the same in accordance with law within a period of 90 days and to pass appropriate order after providing due opportunity hearing to the petitioner as well as other necessary parties, if necessary. 7. It is made clear that this Court has not expressed any opinion on the merits of the case, and the authority concerned shall be at liberty to pass order(s) on its own merits, in accordance with law. 8. With these observation(s) and direction(s) this petition is disposed of. CC as per Rules. Sd/- (Amitendra Kishore Prasad) Judge Saxena
