JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned Additional Government Advocate accepts notice for respondent No.1 Sri. Francis Xavier, learned counsel is directed to accept notice for respondent No.2. 2. Petitioner is before this Court seeking for the following reliefs: WHEREFORE, petitioners pray that this Hon'ble Court may be pleased by issue a writ of mandamus or any other writ order and direct the respondents: a. To consider the representation made by the petitioner dated 01.05.2025 (Annexure-E and F). b. Declare the police notice dated 04.04.2025 as ultra vires, illegal, unconstitutional, and void ab initio. (Annexure -D) c. To notify the police stations about this Hon'ble Courts order after S.91 notice has been sent to the bank. d. Not to mark lien/debit freeze on bank account of the petitioner and allow the petition, or pass such order as this Hon'ble Court deems fit in the interests of justice and equity. 3. Respondent No.1 had vide Annexure-D dated 04.04.2025 called upon respondent No.2/Bank to mark a lien for an amount of Rs.2,50,000/- as also an amount of Rs.4,00,000/- in pursuance of Cen Crime PS. Crime No.716/2024 registered under Section 66(C), 66(D) of the Information Technology Act, 2000, and Sections 318(4) of the Bharatiya Nyaya Sanitha, 2023. 4. Since the Police Station which had issued the notice under Sections 94 and 106 of the Bharatiya Nyaya Suraksha Sanhita, 2023 is situated within the State of Karnataka and there is already a crime number registered pending. 5. Reserving liberty to the petitioner to approach the Court seized of the said crime, criminal proceedings for lifting the lien, the petitioner stands disposed.
