G.P. for Revenue The Court made the following: 2 BSB, J W.P.No.14169 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…to issue a writ, order, or direction, more particularly in the nature of a writ of mandamus, declaring the inaction of the respondent authorities in conducting the land survey and fixing the boundaries of the petitioner’s land in pursuance of petitioner's F-Line application vide application No. FSNV012500822711, dated 03.09.2025 in respect of petitioner's land situated in Survey No. 412-1 of Guthinadeevi Village, I. Polavaram Mandal, Dr. B.R. Ambedkar Konaseema District despite the issuance of a statutory notice under Section 23 of the Andhra Pradesh Survey and Boundaries Act, 1923 despite payment of the requisite survey fee within the mandatory period of thirty (30) days is nothing but violation of fundamental rights of person guaranteed under the Constitution of India and is contrary to the observations of this Court judgment in the case of Muramalla Padmavathi Vs. State of Andhra Pradesh (2016) LawSuit(Hyd) 105 and consequently direct the respondents to conduct survey and fix boundaries in respect of petitioner’s F-Line application vide application No. FSNV012500822711, dated 03.09.2025 in respect of the petitioner’s land and to pass…” 2. The case of the petitioner is, stated briefly, as follows: a. The petitioner is the absolute owner and possessor of agricultural land admeasuring to an extent of Ac.7.800 cents in Sy.No.412-1, Guthinadeevi Village, I. Polavaram Mandal, Dr. B.R. Ambedkar Konaseema District. The petitioner submitted an application to the respondents vide application No.FSNV012500822711 on 03.09.2025, seeking survey of the said land for fixation of boundaries. A notice dated 3 BSB, J W.P.No.14169 of 2026 08.09.2025 was issued under Section 23 of the Andhra Pradesh Survey and Boundaries Act, 1923. Since then, the respondents failed to conduct survey causing hardship to the petitioner. Hence, this writ petition was filed. 3. The learned Assistant Government Pleader for Revenue placed on record a copy of written instructions of the respondent No. 4 vide Ref. B/104/2026, dated 15.06.2026. As per the written instructions, an endorsement dated 12.09.2025, was passed stating that the petitioner’s land sought to be surveyed was submerged under Godavari river flood waters and that the survey operations could not be undertaken, and the petitioner was further informed to file a fresh written application for conducting survey. 4. Sri A. Tarun Kumar, learned counsel representing the learned counsel for the petitioner, requested to pass appropriate orders with liberty to the petitioner to file a fresh application before the appropriate authority for conducting survey in the subject land. 5. As per the written instructions, the petitioner can be permitted to submit a fresh application when the flood water recedes. 6. In the result, the writ petition is disposed of giving the petitioner liberty to submit a fresh application before the concerned authorities for the same relief when the land is accessible after recession of water. On receipt of such application, the respondent authorities shall pass appropriate order as per law.
