“10.1 This Hon'ble Court may kindly be pleased to direct the respondent authority to regularise of patta to the petitioner in respect of the land in accept patta land bearing Khasra No. 300, comprising Plot Nos. 145, 146, and 147, having a admeasuring of 1864 sq. ft., situated at Mouza Village Bhilai-3, Tehsil and Municipal Corporation Bhilai-3, District Durg (C.G.) ,within a period of 1 month. 10.2 This Hon'ble Court may kindly be pleased to issue any other order or orders, writ or writs, direction or directions as this Hon'ble court may deem fit in the facts and çircumstances of the case in favor of the Petitioner, in the interest of justice.”

Learned counsel for the petitioner submits that the petitioner has filed the present petition seeking a limited relief of directing the respondent authorities to regularise the Patta/lease in favour of the petitioner in respect of land bearing Khasra No.300, comprising Plot Nos.145, 146 and 147, admeasuring 1864 sq. ft., situated at Mouza Village Bhilai-3, Tehsil and Municipal Corporation Bhilai-3, District Durg. He further submits that pursuant to the provisions of the Madhya Pradesh Nagariya Kshetro Ke Bhoomihin Vyakti (Pattadhriti Adhikaron Ka Pradan Kiya Jana) Adhiniyam, 1984 and the Rules framed thereunder, a demand notice was issued by the SDO (Revenue)/Competent
3 Authority and Municipal Corporation Bhilai-Charoda, District Durg, requiring the petitioner to deposit a sum of Rs.4,11,639/- towards regularisation of the land in question, including development charges and other applicable charges.
It is further submitted that the petitioner has already deposited the aforesaid amount vide Challan No.J-248462768/26 dated 21.03.2023 and thereafter submitted an application before the competent authority seeking an appropriate order for regularisation of the land in question; however, despite the lapse of considerable time, the said application has not yet been considered or decided since the petitioner has already deposited the amount. 3. Learned State counsel has no objection to the limited prayer made by the petitioner and submits that if Court directs the competent authority will consider and decide the same in an expeditious manner preferably within 45 days. 4. Learned counsel for the Municipal Corporation is having no objection if such order to consider the applicable be passed. 5. I have heard learned counsel for the parties and perused the records with utmost circumspection. 6. Considering the facts and circumstances of the case, and also taking into consideration the fact that the petitioner has already deposited the demanded amount, including development charges and other applicable charges, way back in the year 2023, the present petition is disposed of with a direction to the petitioner to
4 file a fresh application along with a copy of the present petition, raising all the grievances as raised herein, before the respondent No.3/Competent Authority within a period of 07 days from today. Upon receipt of such application, the respondent No.3/Competent Authority shall consider and decide the same, in accordance with law, within a further period of 45 days. It is made clear that this Court has not expressed any opinion on the merits of the case. 7. With these observation(s) and direction(s) this petition is disposed of. CC as per Rules.
