In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Rajapur Police Station Case No. 133 of 2025 dated 12.05.2025 under Sections 20(b)(ii)(C)/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 1 year and 2 months. Charge sheet has already been submitted and the prosecution has relied upon 24 witnesses in support of its case. There being no possibility of the trial being taken to its logical conclusion within a reasonable period of time, petitioner prays for bail on any stringent conditions.
Learned advocate for the State submits that there has been total recovery of 192 Kgs. of Ganja in the present case and as one of the accused persons is absconding trial cannot proceed.

Having regard to the period of detention of the present petitioner, I direct the learned Trial Court to split up the case after exhausting the process of law.
Learned Trial Court would give priority to the deposition of the seizure list witnesses preferably within a period of 3 months from the date of overcoming the stage of consideration of charges.
Petitioner would approach this Court after the evidence of the seizure list witnesses are over.
With the aforesaid observations CRM (NDPS) 1384 of 2026 is dismissed at this stage.
Learned Special Court would adhere to the directions passed above.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
