JUSTICE NELSON SAILO ORDER Date : 07-04-2026 Heard Mr. BP Borah, learned counsel for the applicant/petitioner, who submits that by filing this interlocutory application, the applicant seeks impleadment of Smti. Sumitra Dev, AES, Deputy Director of Higher Education Department as respondent No. 3 in the connected Cont.Cas(C) 260/2024, in view of the fact that the said person had issued a show-cause notice to the applicant after the passing of the speaking order. [2.] The learned counsel submits that vide judgment and order dated 19.10.2023 passed in WP(C) 2555/2020, liberty was granted to the official respondents to initiate departmental proceedings, as per the procedure prescribed by the Rules, if so advised within a period of 3 (three) months. Pursuant thereto, the speaking order was passed and off late a show-cause notice was issued to the applicant and as such, the impleadment is necessary for effective compliance of the Court’s direction. [3.] Mr. S Das, learned counsel appears for the respondent No. 1 and submits that he has no objection if the impleadment application is allowed andMr. SK Muktar, learned counsel appears for the respondent No. 2 and also agrees to the submission of the respondent No. 1. [4.] In view of above, impleadment of Smti. Sumitra Dev, AES, Deputy Director of Higher Education Department as respondent No. 3 in Cont.Cas(C) 260/2024 Page No.# 3/3 is hereby allowed, as prayed for.
