S/L 35 28.07.2026 Court No.24 SD
IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION
WPA 25145 of 2024
Rami Chakraborty & Anr. Vs. The State of West Bengal & Ors. Mr. Pinaki Dhole Ms. Pranita Mandal Mr. Arunava Ganguly … for the Petitioners. Dr. Sutanu Kumar Patra Ms. Supriya Dubey … for WBCSSC. 1. Affidavit of service filed in Court today be kept with the records. 2. The petitioners participated in the Upper Primary selection process initiated in the year 2016. The entire selection process stood set aside by the Court. The same started afresh in the year 2021. Prior thereto the candidates had the opportunity to file their individual grievances and the authority considered the individual grievance of the candidates. 3. Allegation of the petitioners is that they were not allowed to upload their documents in the selection process which started afresh in the year 2021. The petitioners did not file any grievance before the authority. 4. It has been submitted that as the counselling process is ongoing, the petitioners may be granted a chance to appear in the said process. 5. Such submission of the petitioners is opposed by the learned advocate representing the Commission. 2
6. It has been submitted that the petitioners never filed any grievance before the authority. The petitioners never participated in the fresh selection process which started in the year 2021. 7. Upon hearing the parties, it appears that there is nothing on record to suggest that the petitioners submitted their grievances. There is also no document to show that the petitioners uploaded or tried to upload their credentials at the time of initiation of the fresh selection process in the year 2021. The instant writ petition has been filed in September 2024. 8. Had the petitioners been aggrieved by the action of the authority in not allowing them to upload their documents in the fresh selection process in the year 2021, they ought to have approached the Court immediately thereafter. 9. The petitioners waited for nearly three years to approach the Court. Right now counselling is being conducted for those candidates who participated in the fresh selection process. At this stage, there is no scope to grant any relief to the petitioners. 10. In view of the above, no relief can be granted to the petitioners in the instant case. The writ petition fails and is hereby dismissed. 11.
