The petitioners who are the husband and members of the matrimonial family of the opposite party seek transfer of miscellaneous case no. 955 of 2025 pending before the learned Judicial Magistrate, 1st Court, Howrah to learned Judicial Magistrate, Contai, Purba Medinipur on the ground that both the parties are residents of Purba Medinipur and it shall be convenient for them to appear before any Court in Tamluk for conducting the case. It appears that the notice issued upon the opposite party was received by her at her address in Purba Medinipur and the notice sent at her other address , that is, at Howrah returned with an endorsement ‘ no such person in the address’. It appears that both the parties are ordinarily residents of Purba Medinipur. It shall be convenient for them to appear before the Court in Contai to conduct the case pending between them. In view of the above, the application being CRR 1463 of 2026 is allowed. 2 Miscellaneous Case no.955 of 2025 pending before the learned Judicial Magistrate, 1st Court, Howrah be transferred to the Court of the learned Additional Chief Judicial Magistrate, Contai, Purba Medinipur for disposal. Learned Additional Chief Judicial Magistrate shall either deal with the case himself or assign the same to any other learned Magistrate within his jurisdiction. Learned Magistrate, first Court, Howrah is directed to transmit the case record alongwith all relevant documents to the Court of the learned Additional Chief Judicial Magistrate, Contai, Purba Medinipur within 10 days from the date of communication of this order.
