PP Mr. Subir Ganguly Mr. Sandeep Prasad Shaw …for the State This Court finds substance in the grievance raised by the petitioner regarding the inordinate delay in the disposal of the proceeding being G.R. No. 617 of 2007, arising out of Rajarhat Police Station Case No. 165 of 2007 dated 7 April 2007, registered under Sections 323, 325, 341 and 506 of the Indian Penal Code, which culminated in the submission of Charge Sheet No. 23 of 2013 dated 27 March 2013 under Sections 341, 325, 506 and 34 of the Indian Penal Code. The said proceeding is presently pending before the Court of the Learned 2nd Judicial Magistrate, Barasat, North 24 Parganas. The petitioner is one of the accused persons in the said proceeding. The charge sheet was submitted on 27 March 2013 against four accused persons under Sections 2 323, 325, 341 and 506 of the Indian Penal Code. It appears that two of the accused persons expired during the pendency of the proceeding. The remaining two accused persons have been participating in the proceeding. It further appears that the matter was last taken up for hearing on 7 February 2026, when the Learned Magistrate was pleased to fix 10 September 2027 as the next date for the appearance of the present petitioner and the co-accused. Having regard to the prolonged pendency of the proceeding, this Court directs the Learned Magistrate in the Court below to take necessary steps for concluding the charge hearing within a period of three months from the date of communication of this order. The petitioner shall be at liberty to file an appropriate application before the Learned Magistrate for preponing the date fixed for appearance. Accordingly, CRR 2912 of 2026 stands disposed of.
