Accused in S.C.No.5013 of 2026 pending before the court of VIII Additional District and Sessions Judge, Mysuru (Sitting at Hunsur) arising out of Crime No.317 of 2025 registered by Saligrama Police Station, Mysuru District, for offence punishable under Section 103(1) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.317 of 2025 was registered by Saligrama Police Station, Mysuru District against the petitioner herein for the aforesaid offence, based on the first information dated 03.11.2025, received from Sri Naveen Kumar, son of deceased Kumara. In the said case, petitioner was arrested on 04.11.2025 and remanded to judicial custody. His bail application filed before the trial Court in Crl.Misc.No.5034 of 2026 was rejected on 17.02.2026. Perusal of the material on record would go to show that, petitioner's wife had eloped with late Papaiah, who was the brother of deceased Kumara. Allegation as against the petitioner is that in the aforesaid background, he had ill-will against Kumara and on 03.11.2025, he had quarreled with the deceased in the aforesaid background and had assaulted him with his hands and committed his murder. 5. Investigation of the case is completed and charge sheet has been filed. Petitioner aged 53 years, who is a agriculturist by avocation has no other criminal antecedents. Allegation as against him is that in view of the aforesaid ill-will, he had quarreled with Kumara and assaulted him with his hands on the alleged date of the incident. As a result of the assault made by the petitioner, Kumara fell down on the ground and though, he was immediately shifted to hospital, he had died while undergoing treatment. 6. Post mortem report of the deceased does not give a conclusive reason for the death of deceased Kumara, who was aged 55 years. The dead body of deceased Kumara had certain - 4 - HC-KAR CNR: KAHC010424822026 NC: 2026:KHC:38785 CRL.P No. 9038 of 2026 abrasions on his hands and the post mortem report does not reflect any serious internal injuries. 7. It is not in dispute that petitioner had assaulted the deceased with his hands after quarreling with him. Allegation against the petitioner is that he had assaulted deceased - Kumara with his hands on his cheek and stomach. 8. Considering the nature of allegations found against the petitioner and also taking into consideration that petitioner is an agriculturist by avocation who has no criminal antecedents, the investigation of the case is now complete, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 9. Accordingly, the following:- ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.5013 of 2026 pending before the court of VIII Additional District and Sessions Judge, Mysuru (Sitting at Hunsur) arising out of Crime No.317 of 2025 registered by Saligrama Police - 5 - HC-KAR CNR: KAHC010424822026 NC: 2026:KHC:38785 CRL.P No. 9038 of 2026 Station, Mysuru District, for offence punishable under Section 103(1) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
