In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with English Bazar PS Case No. 2396 of 2025 dated 22.11.2025 u/s 103(2)/109/49 of the BNS, 2023 corresponding to GR Case No. 657 of 2026.

In the matter of : Sagar Mandal @ Sagar Mondal
… Petitioner(s)
Md. Wasim Akram
… for the petitioner(s)
Mr. Krishnendu Bhttachrya, APP Ms. Tanusree Kar
… for the State-respondent(s)
Learned advocate for the petitioner submits that the petitioner was the owner of the mobile, as such, he was implicated in the present case. Learned advocate emphasizes that the present petitioner had no role to play in the accusations. However, as the mobile was recovered from the person concerned, the petitioner has been implicated with the accusation under section 103(2) of the BNS. Mr. Krishnendu Bhattacharya, learned APP, appears for the State along with a junior of his choice as per the direction of this court. The appointment of both Mr. Bhattacharya and the junior of his choice, if any, be
2 regularized by the concerned authority. Learned advocate for the State opposes the prayer for anticipatory bail. Having considered the materials appearing in the case diary, I am of the opinion that this is not a fit case to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the present petitioner is rejected. Accordingly, CRM (A) 1398 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
