Learned advocate appearing for the petitioner submits that the quantum of recovery in the present case is 12 kgs. of ganja. Petitioner is in custody for 56 days and there is no possibility of the trial being concluded in near future, as such, petitioner may be released on bail.
Learned advocate for the State submits that there are criminal antecedents in respect of similar offences by the petitioner.
Be that as it may, having regard to the quantum of recovery in the present case, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Mahammad Rafik @ Md. Rafik shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one
2 of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Purba Medinipur. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Purba Medinipur without prior permission of the learned special court.
Thus, CRM(NDPS) 1535 of 2026 is allowed.
