CRR 1901 of 2026
Avik Paul - vs- State of West Bengal & Ors.
Ms. Jharna Biswas
…for the petitioner Mr. Kallol Mondal Mr. Subir Ganguly Mr. Neel Chakraborty
…for the State
The present revisional application has been filed seeking a direction for expeditious disposal of G.R. Case No. 11678 of 2022 under Sections 341, 323, 325, 307, 427 and 448 of the Indian Penal Code, 1860, presently pending before the Court of the Learned Judicial Magistrate, 1st Court, Barrackpore, North 24 Parganas. It appears from the materials on record that when the matter was last taken up on 2 September 2025, the Learned Magistrate fixed 20 August 2027 as the next date for the appearance of the accused persons. It further appears that the accused persons remained absent on several occasions before the Learned Magistrate, and their prayers for adjournment were repeatedly allowed. Having regard to the protracted pendency of the proceedings, this Court deems it appropriate to dispose of the present revisional application by directing the Learned Magistrate in seisin of the matter to conclude the hearing on charge as expeditiously as possible, preferably within a period of three months from the date of communication of this order, without granting any unnecessary adjournments to either of the parties.
2 The petitioner shall be at liberty to move an appropriate application before the Learned Magistrate seeking preponement of the next date of hearing. Accordingly, CRR 1901 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
