HON'BLE MR. JUSTICE GANESH RAM MEENA Order 22/04/2026 1. The petitioner has filed this anticipatory bail application under Section 482 of B.N.S.S., 2023, arising out of F.I.R. No.160/2025 registered with the Police Station, Bansur, District Kotputli-Behror for offence under Sections 121(1) and 132 of B.N.S., 2023, Section 3 of the Prevention of Damage to Public Property Act, 1984 and Sections 27, 29 and 38 of Wild Life (Protection) Act, 1972. 2. Heard. 3. Considered the submissions made by the learned counsel for the petitioner as well as the learned Public Prosecutor, who opposed the bail application. 4. As per the facts on record, the F.I.R. No.160/2025 has been registered with the allegation against about 150 persons for [2026:RJ-JP:17061] (2 of 3) [CRLMB-5085/2026] raising construction in the forest area. It is submitted by the learned counsel for the petitioner that the petitioner was only a labourer and was engaged by the Mandir Samiti for doing labour and he has nothing to do with the encroachment over the forest land. 5. The Court vide order dated 07.04.2026, directed the petitioner to appear before the Investigating Officer. As per the interrogation report, the petitioner is said to have appeared before the Investigating Officer and has been interrogated. 6. Having regard to the submissions made by the learned counsel for the petitioner and so also the fact that the petitioner has joined the investigation, this Court deems just and proper to extend the benefit of anticipatory bail to the petitioner. 7. The Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Bansur, District Kotputli- Behror, in F.I.R. No. 160/2025 is directed that in the event of arrest of the petitioner he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:- (I). that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the [2026:RJ-JP:17061] (3 of 3) [CRLMB-5085/2026] facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and (iii). that the petitioner shall not leave India without previous permission of the Court.
