PURNIMA GHOSH VS.
STATE OF WEST BENGAL AND ORS.
Ms. Papiya Chattopadhyay, Adv. …For the Writ Petitioner
Mr. Partha Sarathi Basu, Adv. Ms. Ritoprita Ghosh, Adv. …For the Respondent-State
Mr. Partha Sarathi Das, Adv. Ms. Swarnali Ghosh, Adv. …For the Respondent No.5
1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. Learned advocate representing the petitioner submits that petitioner is owner of a shop-room which is presently under possession of respondent nos.5, 6 and 7. It is further submitted on behalf of the petitioner that respondent nos.5, 6 and 7 have no right over the said shop-room in question and on requisition key of the shop-room needs to be handed over to the petitioner. In this regard, prayer is made for directing the concerned police authorities to facilitate handing over of possession of the shop-room to the petitioner.
3. State-Respondents and respondent no.5 are represented by learned advocates and it is contended that issue involved in this writ petition is civil in nature.
4. Having considered the respective submissions made on behalf of the parties, it is found that prayer is made in
this writ petition seeking direction upon the concerned police authorities which will facilitate the process of handing over of possession of shop-room to the petitioner. If possession of the shop-room is not handed over to the petitioner, in that event, police authority is not the appropriate authority to take steps. Petitioner needs to approach Civil Court in pursuit of remedy.
5. Hence, present writ petition is not interfered with and same stands dismissed.
6. However, this order shall not preclude the petitioner to approach Civil Court in pursuit of remedy.
7. Parties shall act on the server copy of this order duly downloaded from the official website of this Court.
