Sub-Inspector Shiv Prasad has investigated the above three complaints and presented the investigation report before me. 3.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is contended that, as per the FIR, the alleged incident occurred on 22.04.2019, whereas the FIR was lodged only on 03.04.2025, and no plausible explanation has been furnished by the complainant for such an inordinate delay. It is further submitted that the applicant neither committed nor participated in any act constituting the alleged offence and that the evidence collected by the prosecution is not prima facie sufficient to establish his involvement. Learned counsel further submits that the applicant was working as a Ward Boy in Government Hospital, Mahasamund, and during the period from 14.02.2022 to 18.12.2022, he was suffering from epilepsy, due to which he could not attend his duties, and the Chief Medical and Health Officer had issued
3 notices to him regarding his unauthorized absence. Thereafter, upon receiving the departmental communications, the applicant submitted his joining report on 19.12.2022. It is also submitted that the applicant has been in judicial custody since 10.06.2026. On these grounds,
learned counsel for the applicant prays that the applicant may be enlarged on bail. 4. On the other hand learned State counsel opposes the bail application of the present applicant and submits that the charge-sheet has been filed in the present case. 5. I have heard learned counsel for the parties and perused the case- diary. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence levelled against the present applicant, the fact that the charge-sheet has already been filed before the competent Court, that the applicant has no criminal antecedents, and that the applicant has been in judicial custody since 10.06.2026, coupled with the fact that the conclusion of the trial is likely to take some time, this Court is of the considered view that the applicant is entitled to be released on bail in the present case. 7.
