Learned advocate appearing for the petitioners submits that the petitioner no.1 is the driver and the petitioner no.2 is the helper. There was recovery of 7500 bottles of phensedyl. Petitioners are innocent and they are unnecessarily detained for one year.
Learned advocate for the State produces the order of the Hon’ble Supreme Court in Special Leave to Appeal (Crl.)5303 of 2026 wherein an accused approached the Hon’ble Supreme Court and the prayer for bail was rejected on 04.05.2026 and six month’s time has been granted for concluding the trial.
Having considered that the Hon’ble Supreme Court granted an opportunity to consider the matter in respect of an accused, I am of the opinion that since the present is a case under the NDPS Act and search and seizure is the main thrust of subject
2 matter, consequently, the prayer for bail of the petitioners are rejected.
Thus, CRM( NDPS) 1046 of 2026 is rejected.
