Order on Board 05 / 08 / 2026
1. This matter is placed before the Court on an office reference arising out of the request dated 14.07.2026 sent by the BHOLA NATH KHATAI Digitally signed by BHOLA NATH KHATAI Date: 2026.08.06 10:44:01 +0530
2 Additional Sessions Judge (FTC), Raipur (C.G.), through the Office of the Principal District & Sessions Judge, Raipur (C.G.), seeking extension of time for proper disposal of Sessions Case No.235/2021. 2. It is noticed that while deciding CRMP No.1653 of 2025, on 13.05.2024, the Co-ordinate Bench of this Court had, for the first time, directed the trial Court to conclude the trial within a period of three months. As the trial could not be concluded within the stipulated period, CRMP No.3767 of 2025 was preferred seeking extension of time. The said petition was allowed on 12.12.2025, whereby the trial Court was granted a further period of three months to conclude the trial. However, the trial could not be concluded even within the extended period. Thereafter, CRMP No.1031 of 2026 was filed seeking a further extension of time, which was allowed by this Court on 13.04.2026, granting an additional period of three months. Despite the aforesaid extensions, the trial has yet not reached its conclusion. Accordingly, the present office reference has been made seeking a further extension of at least two months for conclusion of the trial. 3.
The reason assigned in the request letter seeking extension of time is that the matter is presently at the stage of recording the statement of the accused and that, pursuant to the transfer of the erstwhile Presiding Officer, the case was received by the present Presiding Officer only on 13.07.2026. 4. Having considered the reasons assigned in the request letter and taking into account the entire facts and circumstances of the case, this Court is inclined, as a last opportunity, to grant a further period of two months from the date of receipt of a copy of this order to ensure the final conclusion of the trial. 5. The trial Court shall make every endeavour to conclude the trial within the aforesaid period. The prosecution, the Police
3 Administration and the defence are also directed to extend their fullest cooperation to facilitate conclusion of the trial within the stipulated timeframe. It is made clear that no unnecessary adjournment shall be granted to either of the parties. 6. The Registry is directed to communicate a copy of this order forthwith to the concerned trial Court as well as to the learned Principal District & Sessions Judge, Raipur (C.G.), for information and necessary compliance. 7. The office reference stands disposed of accordingly. /- Sd/-
