1. None appears on behalf of the petitioner, when the matter is called for hearing, nor any accommodation been prayed for.
2. It appears from the office report dated 23rd July, 2026 that the administrative notice could not be served to the petitioner, Dalia Sadhukhan as she has unfortunately passed away. This report is predicated upon the inquiry report submitted by the Learned Seal Bailiff of the Court of Learned Chief Judicial Magistrate, Barasat dated 20.07.2026, which stands duly annexed with the report of the Learned Chief Judicial Magistrate at Flag ‘B’.
3. Learned Counsel appearing before this Court submits that the demise of the sole petitioner has fundamentally destroyed the substratum of the case, thereby rendering the instant proceedings entirely infructuous and incapable of further prosecution.
4. I have meticulously considered the submissions advanced at the bar and perused the materials available on record, including the official report regarding the death of the sole petitioner.
5. I am fully convinced that the death of the sole petitioner abates the cause of action and vitiates the continuance of the present proceedings.
6. Accordingly, the instant application being C.R.R. No. 2591 of 2017 is hereby dismissed as abated.
7. Any interim order, if subsisting, stands vacated.
8. All connected applications, if any, are consequently disposed of.
9. Photostat copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities. (Uday Kumar, J.) 2
