Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 9 months. Earlier, on 02.04.2026 as per the plight expressed by the petitioner, time was granted to examine the seizure list witnesses. Learned advocate for the petitioner submits that till date the seizure list witnesses have not been examined.
Learned advocate for the State opposes the prayer for bail.
From the records of the case, it is not transparent whether the seizure list witnesses till date has been examined or not. Learned trial court is directed to ensure that the seizure list witnesses are examined at the earliest. If after examination of the
2 seizure list witnesses learned trial court is of the opinion that the seizure in the present case has somewhat diluted because of the deposition of the witnesses, in that case, on an application for bail, learned trial court would not hesitate to release the petitioner on bail. However, the prayer for bail before this Court in CRM(NDPS) 1063 of 2026 is rejected at this stage. Learned trial court would adhere to the directions passed above.
