The petitioner is apprehending his arrest in connection with Keredari P.S. Case No.45 of 2018 arising out of Complaint Case No.1306 of 2018, registered for the offence under Sections 313, 376, 354B/34 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1st Class, Hazaribag. 3. Learned counsel appearing for the petitioner submits that initially the complaint case was lodged alleging of establishing physical relationship with the victim. However, subsequently, marriage has been solemnized between petitioner and the victim with the consent of the family members of both the sides. He submits that now the charge sheet has been submitted under Section 498A of the IPC. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that initially the complaint case was lodged and subsequently, it was converted into FIR pursuant to the order of the Court. 5. Considering that the marriage has been solemnized between the petitioner and the victim and in the complaint case, allegations were made of establishing physical relationship and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
