29.07.2026 rc/ct.no.15 Item No.32 WPA No. 18276 of 2026 Aktarul Mondal Versus The State of West Bengal & Ors. Mr. Robiul Islam Sk. Jayed Hossain Mr. Raju Mondal Mr. Masooq Rahman ..for the petitioner Mr. Dilip Kumar Shyamal …for the State Mr. Sarwar Jahan Mr. Asraf Mandal Ms. Shalini Sen Ms. Sahina Parvin …for the private respondent Affidavit of service filed by the petitioner in Court today is taken on record. On the prayer of the petitioner liberty is granted to correct the cause title of the writ petition. The petitioner who is the Pradhan of Natidanga-I Gram Panchayat has assailed the notice issued by the Prescribed Authority on July 20, 2026 on the ground that it is in contravention of Section 12(3) of the West Bengal Panchayat Act, 1973. Also, copy of the motion has not been sent to the petitioner at his residential address. Learned counsel for the private respondents/ requisitionists submits that the notice has been issued within five working days from the receipt of the motion and the motion has been sent to the petitioner at his residential address. It appears that the motion was received by the Prescribed Authority on July 13, 2026. The meeting was fixed on July 30, 2026 by issuance of notice on July 20, 2026 which is in conformity with Section 12(3) of the Act of 1973. Copy of the motion has also been sent to the petitioner at his residential address and received by him on July 17, 2026. In view of the above, this Court is inclined to hold that the writ petition is devoid of any merit and is accordingly dismissed. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh,J) 2
