1. The petitioner claims to be one of the legal heirs of a deceased employee of the Eastern Coalfilds Limited (ECL). He is claiming the terminal benefits payable to the deceased employee, who died-in- harness sometime on July 4, 2016. 2. In terms of the order dated June 20, 2024 of this Hon’ble Court, the ECL has filed a report in the form of affidavit which is kept on record. 3. Though the amounts payable are not in dispute, it is disputed as to who would be entitled to receive such amounts on behalf of the deceased employee, particularly since there are multiple legal heirs. 4. In spite of notice, respondent no. 9 is not represented. 5. In spite of the directions in the order dated June 20, 2024, the petitioner has not taken any steps to implead the other sister, who is alive and is one of the
2 legal heirs of the deceased employee, as a party respondent to this proceeding. 6. In view of the aforestated, no further purpose would be sub-served to keep the writ petition pending. 7. The Coal Mines Provident Fund Organisation is directed to give adequate notice of such hearing to the petitioner as well as respondent no. 9 herein and other alive sister of the petitioner i.e. Ms. Nagina Devi and the heirs of the deceased sister i.e. Janak Dulari Mondal. 8. The said authority will ascertain as to who is entitled to receive the amount of the provident fund payable to the deceased employee, if at all. 9. General Manager, Kenda area of ECL, will decide as to the entitlement of the petitioner and the other legal heirs of the deceased employee and the quantum thereto in so far as the terminal benefits except the provident fund. 10. The entire exercise by the aforestated authorities will be completed within a period of twelve weeks from the date of communication of this order by the petitioner. 11. In the course of hearing if the other legal heirs are not represented, the authorities will obtain necessary particulars from the petitioner and serve notice upon them. 3

I make it clear that hearing can only be proceeded by the authorities concerned upon the petitioner giving adequate notice to the other legal heirs of the deceased employee. 13. With the aforestated directions, the writ petition is disposed of. 14. There will be no order as to costs. 15. Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings. (Reetobroto Kumar Mitra, J.)
