For Petitioner(s): Mr.K Nivesh Kumar For Respondent(s): Mr.N.P.Kumar Special Public Prosecutor ORDER The petitioner, who was arrested and remanded to judicial custody on 06.04.2026 for the alleged offences under Sections 8 (c) r/w 9A, 25 A and 29 of the NDPS Act, 1985, in FNo.DRI/CRU/VIII/48/ENQ-01/INT-01-2026 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioner along with other accused was illegally transporting 24.680 kg of Pseudoephedrine, a controlled substance in a lorry. He stated that Pseudoephedrine is a controlled substance which cannot be used for purposes other than medication. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner along with other accused was illegally transporting 24.680kg of Pseudoephedrine worth approximately Rs.5 crore. Hence, he opposed the grant of bail to the petitioner. 5.Although the learned counsel for the petitioner contended that this is a controlled substance, the quantity involved is huge i.e 24.680kg. According to the prosecution case, its value in the international market is Rs.5 crore which clearly demonstrates the manner in which this controlled substance is being used as a drug. Hence, considering the involvement of commercial quantity, this Court is of the firm view that, if the petitioner is enlarged on bail that would shock the conscience of the society.
