Hon’ble Pankaj Purohit, J. 1. Mr. Hari Mohan Bhatia, learned counsel for the petitioners. 2. Mr. J.P. Joshi, learned Additional Advocate General for the State of Uttarakhand. 3. Petitioners belong to different reserved categories and they are serving in Uttarakhand Secretariat. According to them, Hon’ble Supreme Court in Civil Appeal No. 629 of 2022 issued certain directions, which have not been complied with so far by the State Government. 4. By means of this writ petition, petitioners have sought the following relief:- (i) Issue a writ, order or direction in the nature of mandamus and direct the respondent to complete the exercise as contemplated and pronounced by the Hon’ble Supreme Court in the case of Civil Appeal No. 629 of 2022 (Jarnail Singh Vs. Lachhmi Narayan Gupta dated 28.01.2022, before making promotion in any of the cadre of services in the State of Uttarakhand to complete the exercise for inadequacy of cadre wise representation of Scheduled Caste and Scheduled Tribes by preparing cadre wise roaster of each cadre of each services in the State of Uttarakhand. 5. Mr. J.P. Joshi, learned Additional Advocate General for the State submits that Civil Appeal No. 629 of 2022 (Jarnail Singh vs. Lachhmi Narayan Gupta) is still pending before Hon’ble Supreme Court, and the directions are interim in nature. 2026:UHC:2005-DB He further submits State Government constituted Justice Irshad Hussain Committee in terms of the judgment rendered by Hon’ble Supreme Court in the case of M. Nagaraj. He submits that Justice Hussain Committee has submitted report to the State Government, and the matter is pending consideration before the State Government. 6. After arguing for a while, Mr. Hari Mohan Bhatia, learned counsel for the petitioners submits that petitioner be permitted to make representation to the Secretary, Department of Appointment and Personnel, who may be directed to take decision on the representation. 7. The writ petition is, accordingly, disposed of with liberty to petitioners to make joint representation to Secretary, Department of Appointment and Personnel, Government of Uttarakhand within two weeks from today. If petitioners make such representation within stipulated time, Secretary concerned shall make endeavour to take decision on the said representation as early as possible, preferably within nine months from the date of presentation of representation with certified copy of this order.
