The petitioner has been made accused in connection with Hussainabad P.S. Case No.21 of 2026 registered for the offences punishable under Sections 3(5) of the BNS, 2023 and under Sections 20(b) (ii) (B), 25, 29 of the NDPS Act. Learned senior counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was in illegal possession of 3.085 Kgs of Ganja kept in four plastic bags for which recovery the husband of the petitioner namely Uday Prasad @ Bablu Gupta has also been made accused. It is submitted that the allegation against the petitioner is false. It is next submitted that from the house of Durga Devi, 4.259 Kgs of Ganja and from the house of the Savita Devi 2.992 kgs of Ganja was recovered. It is next submitted that the Ganja recovered comes under the intermediate quantity. It is next submitted that the petitioner undertakes that she will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 03.02.2026 as mentioned in para-06 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Palamau in connection with Hussainabad P.S. Case No.21 of 2026 with the condition that she will co-operate with the trial of the case and furnish her mobile number and photocopy of the Aadhar Card in the court below with an undertaking that she will not change her mobile number during the trial of the case.
