(2) Petitioners are residents of Village Chandpuri Khadar, Tehsil Laksar, District Haridwar. According to them, the State Government had issued a notification under Section 4A(2) of U.P. Consolidation of Holdings Act, 1953, as applicable to Uttarakhand, on 12.7.2012, but thereafter no further step was taken. By means of this writ petition, petitioners have sought the following reliefs:
“I. A writ, order or direction in the nature of Mandamus, directing the respondents commanding the respondents to complete the consolidation of land proceedings of Village Chandpuri Khadar Khurd, Pargana Gordhanpur, Tehsil Laksar, District Haridwar, as expeditiously as possible under the facts and circumstances of the case and/or within a definite period of time.
II. Declare inaction on the part of respondents for not concluding the consolidation proceedings in the Village Chandpuri Khadar Tehsil Laksar District Haridwar.”
(3) Mr. Yogesh Pande, learned Deputy Advocate General, submits that the village in question is situate on the border of State
2026:UHC:2691 of U.P. and State of Uttarakhand and due to boundary dispute, the consolidation proceedings could not be held.
(4) Coordinate Bench of this Court had required presence of senior officers of Revenue Department of both the States for resolving the border dispute. Mr. Yogesh Pande, learned Deputy Advocate General, on instructions, submits that the border dispute has now been resolved and as per the letter received from the Secretary, Board of Revenue, Uttarakhand, 30 months would be needed for completing the consolidation proceedings. The letter dated 8.4.2026, issued by the Secretary, Board of Revenue and other letters, produced in the Court, are taken on record.
(5) In view of the assurance given by the Secretary, Board of Revenue, writ petition is disposed of by providing that consolidation proceedings shall be completed in respect of Village Chandpuri Khadar, Tehsil Laksar, District Haridwar within 30 months from today.
