1. Heard on I.A.No.01/2021, an application under Section 5 of the Limitation Act for condonation of delay.
2. This is claimants’ appeal for enhancement of the award amount.
3. There is delay of 712 days in filing the appeal.
4. Upon due consideration and for the reasons mentioned in the application, the same is allowed. Delay of 712 days in filing the appeal is hereby condoned.
5. Also heard on admission.

The claimants have preferred this appeal under Section 173 of the Motor Vehicles Act, 1988 (for short ‘the Act’) for enhancement of the award dated 27.11.2018 passed by the learned 3rd Additional Motor Accident Claims Tribunal, Janjgir-Champa (C.G.) in Motor Accident Claim Case No.89/17, whereby the claim petition filed by the claimants under Section 163(A) of the Act was partly allowed
3 and awarded a total sum of Rs.5,00,000/- as compensation to the claimants, who are the wife and children of deceased Shiv Shankar Sahu, who died in a road accident which took place on
21.08.2016.

Learned counsel for the appellants, placing reliance upon the notification dated 22.05.2018 issued by the Ministry of Road Transport and Highways, submits that the compensation prescribed under the amended Second Schedule is subject to an annual enhancement of 5% with effect from 01.01.2019. It is, therefore, submitted that the compensation of Rs.5,00,000/- awarded to the appellants is liable to be enhanced by applying the said 5% annual increase. 8. On the other hand, learned counsel for respondent No.3- Insurance Company submits that the accident in the present case occurred on 21.08.2016, whereas the aforesaid notification was issued on 22.05.2018 and the annual enhancement of 5% was made applicable only with effect from 01.01.2019. Therefore, the benefit of said notification cannot be extended to the claimants. 9. I have heard learned counsel for the appellants and respondent No.3, considered their rival submissions made herein-above and went through the notification dated 22th May, 2018 issued by the Ministry of Road Transport and Highways. 10. For ready reference, the notification dated 22th May, 2018 issued by the Ministry of Road Transport and Highways is reproduced herein as under :-

Having considered the submission advanced by learned counsel for the parties, this Court finds that the accident in question took place on 21.08.2016, whereas the aforesaid notification dated 22.05.2018 provides for an annual enhancement of 5% in the amounts of compensation specified in clauses (a) to (c) of
5 paragraph 1 of the Second Schedule with effect from 01.01.2019. Accordingly, the contention advanced by learned counsel for the appellants seeking enhancement of compensation on the basis of the said notification is devoid of merit and is hereby rejected. 12. Accordingly, the appeal preferred by the appellants for enhancement of the award amount, being devoid of merit, deserves to be dismissed and is hereby dismissed at the admission stage itself. 13. Records of the Tribunal along with a copy of this judgment be sent forthwith for compliance and necessary action, if any.
