THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned AGA accepts notice for respondents. 2. The petitioners are before this Court seeking for the following reliefs: i. Pass/grant writ of mandamus or order or direction directing the respondent No.2 herein to consider and take necessary action on the application submitted by the petitioners No.1 and 2, for issuance of "BEDA JANGAMA" Schedule Caste certificate, vide acknowledgement No.RD1219267090353 dtd: 09.01.2024 and vide acknowledgement No.RD1219267090351 dtd: 09.01.2024 respectively, in accordance with law [ANNEXURES-H & JJ, in the interest of justice and equity. ii. Pass / grant any other relief which this Hon'ble Court deems fit under the facts and circumstances of the case even including the cost of this petition, in the interest of justice and equity. - 3 - HC-KAR CNR: KAHC010441472025 NC: 2026:KHC:38211 WP No. 20544 of 2025 3. The grievance of the petitioner is that the application of the petitioner for issuance of a Schedule Caste Certificate dated 09.01.2024 at Annexure-H and J have not been considered and orders have not been passed. 4. Whenever any application is filed for issuance of any certificate, it is but required for the concerned authority to consider the same and pass necessary orders within a reasonable period of time either accepting or rejecting the request made. 5. Needless to say, if an order of rejection is passed, the same would have to be accompanied by reasons. 6. The applications filed by the petitioner were way back on 09.01.2024 which are yet to be considered. In that view of the matter, this Court is of the considered opinion that the time taken is not reasonable. As such, this Court passes the following; ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing respondent No.2 to consider the applications submitted by the petitioners on 09.01.2024 at Annexure H and J and pass necessary orders within a period of 60 days from the date of receipt of a copy of this order. - 4 - HC-KAR CNR: KAHC010441472025 NC: 2026:KHC:38211 WP No. 20544 of 2025 iii. The petitioner is at liberty to furnish such other and further documents that the petitioner wishes to rely upon, which shall be so furnished on or before 07.08.2026. iv. It is made clear that this Court has not expressed any opinion in the entitlement of the petitioner.
