Learned advocate appearing for the petitioner submits that the gross recovery in the present case is 9985 grams of ganja from the possession of the petitioners at Calcutta Airport. Complaint has already been submitted before the jurisdictional court. Learned advocate for the Air Customs Authority opposes the prayer for bail. Having regard to the quantum of recovery in the present case, I am of the opinion that the principles set out in the judgment of Hon’ble Supreme Court in Barnali Bag Vs. Union of India (Special Leave Petition (Crl.) No.3641 of 2026) is applicable to the facts of the present case. 2 Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Mr. Javid Sharif Aslam Sherif shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 8th Court, Barasat, 24 Parganas (North). If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of 24 Parganas (North) without prior permission of the learned special court. Additionally, petitioner shall provide his address and make himself available to the investigating officer of the case or any officer assigned by the Principal Commissioner, Air Customs Authority. Thus, CRM(NDPS) 1533 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
