1. The petitioner has filed this petition seeking following relief (s) :
“10.1 That the Hon'ble Court be pleased to call for the entire records in connection of the petitioner's cases.
10.2. That the Hon'ble court be further pleased to direct the Respondent authorities to consider the case of the petitioner as per circular dated 12.12.14 (Ann.P/8) for reinstatement on the post of peon in
-2- contingency establishment as he has worked 3 years continuously on Collector rate. 10.3 Any other order that the Hon'ble Court deems fit and necessary in the circumstances of the case be also passed.
10.4. That the cost of the petition be also awarded to the petitioners.”
2. Learned counsel for the petitioner would submit that the petitioner was appointed on a post of ‘Peon’ on daily wages under respondent No.3 pursuant to his appointment order dated
10.12.2010. He would further submit that the petitioner worked till 2013, thereafter, his services were discontinued. He would also submit that the petitioner and other similarly situated employees filed WPS No.4232 of 2012 before High Court and same was
disposed of vide order dated 27.09.2013 with an observation that the State Government would scrutinize the matter of the petitioner(s) in accordance with the memo dated 07.03.2012. He would contend that the State Government on 12.12.2014, issued a circular wherein, the District Collector/s was/were directed to adjust the vacant posts of Contingency Fund for Class IVth employees working on a Collector Rate, but the case of the present petitioner was not considered and he was removed in the year 2013; thus, he would pray that the respondent authorities may be directed to consider the claim of the petitioner in pursuance of circular dated 12.12.2014.
3. On the other hand, learned State counsel would oppose. He would submit that an advertisement was issued for the filling up of posts of Peon (cook, waterman, etc), and these posts have already been
3 filled through recruitment process. He would further submit that earlier, writ petition was filed before this Court by the petitioner and similarly situated persons, and same was disposed of with a direction to the State Government to scrutinize the matter of petitioner(s), and the circular dated 12.12.2014 was issued subsequently.

Taking into consideration the fact that the post ‘Peon’ on which the petitioner was working on daily wages, has already been filled up by the authorities concerned through direct recruitment process, therefore, no case is made out for grant of any relief as sought by the petitioner. However, the petitioner would be at liberty to make a representation for consideration of his claim in accordance with circular dated 12.12.2014. It is expected that, if any, representation is made by the petitioner, the authority concerned would consider and decide the same expeditiously.
5. With the aforesaid observation(s) and direction(s), the instant petition is hereby disposed of. Sd/-
