29.07.2026 Serial no. 45 [G.S.D] CRM (NDPS) 1341 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Khejuri PS Case No. 580 of 2025 dated 21.10.2025 u/s 20(b)(ii)/25/29 of the NDPS Act, TR (NDPS) No. 7 of 2026. -And- In the matter of : Shankar Shil … … Petitioner(s) Mr. A. K. Samanta … for the Petitioner(s) Mr. Sagar Saha Ms. Nayana Mukhopadhyay … for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the recovery in the present case is 22 kg of ganja from the joint possession of the two accused persons: one of them being the petitioner. Learned advocate for the State opposes the prayer for bail and submits that there are materials available against the present petitioner. I have taken into account the materials appearing in the case diary and the charge-sheet depicting that the prosecution has relied upon 18 witnesses in support of its case as also the period of detention of the present petitioner being about nine months. Having regard to the same and the fact that trial of the case is supposed to commence which will take some 2 time to reach to its logical conclusion, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Shankar Shil shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), Tamluk, Purba Medinipur. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of Purba Medinipur without prior permission of the learned Special Court/trial court. Accordingly, CRM (NDPS) 1341 of 2026 is allowed. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.) 3
