ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents.
2. Learned Senior Counsel Sri. Ashok Harnahalli, appearing for the petitioner-Trust submits that although there is no specific direction by the Hon’ble Division Bench in W.P.No.35256/2024 at Annexure-R, where the petitioner herein is respondent No.6, nevertheless, the respondent-Tahsildar, Bengaluru East Taluk has issued the impugned Notice at Annexure-S, dated 18.03.2026 threatening to take action to remove the alleged encroachment on the Rajakaluve. Learned Senior Counsel submits that at reference No.10 in the impugned Notice, the Tahsildar refers to the reply given by the petitioner on 16.03.2026, nevertheless, the Tahsildar proceeds to state that there is nothing in the reply that would prevent the Tahsildar from proceeding against the petitioner-Trust to remove the encroachment on the Rajakaluve. Learned

Senior Counsel would therefore submit that if the impugned Notice/Order is not stayed the Tahsildar will proceed to take action without even affording an opportunity of hearing to the petitioner.
3. In the considered opinion of this Court, since action has been taken by the respondent-Tahsildar pursuant to the orders passed by the Hon'ble Division Bench in a Public Interest litigation, the petitioner-Trust is required to make its submission before the Hon'ble Division Bench.
4. Learned Senior Counsel submits that the said writ petition has been disposed of by order dated 29.08.2025. Nevertheless, this Court is of the opinion that the forum for redressal of the grievance of the petitioner-Trust is before the Hon'ble Division Bench.
5. Accordingly, the writ petition stands disposed of permitting the petitioner-Trust to file necessary application before the Hon'ble Division Bench in the disposed of

matter bringing to the notice of the Hon'ble Division Bench the grievance of the petitioner.
6. For that purpose, four weeks time is granted to the petitioner-Trust to approach the Hon'ble Division Bench. In the meanwhile, the 4th respondent-Tahsildar, Bangalore East Taluk, is hereby directed not to precipitate the matter any further for a period of four weeks.
7. Learned High Court Government Pleader is permitted to file memo of appearance within a period of four weeks from today.
