JUSTICE ANJAN MONI KALITA ORDER 23.02.2026 Heard Ms. G. Borah, learned counsel for the accused/applicants. Also heard Mr. K.K. Das, learned APP for the State. 2. This is an application under Section 483 of the BNSS, 2023 for granting bail to the accused/applicants in connection with Lanka P.S. Case No.225/2025 under Sections 61(2)/319(2)/318(4)/336(3)/3(5) of the BNS, 2023 read with Section 66D IT Act. 3. This case pertains to the cheating of the complainant of a substantial amount of money. The accused/applicants allegedly used multiple mobile numbers to falsely identify themselves as individuals residing in Italy, Ukraine, and other foreign countries. They deceived the victim/informant by claiming that one of these persons was getting married and invited her to Delhi. The accused repeatedly demanded that certain amounts be deposited into specified accounts. The informant deposited the money under the belief that he would come from Italy and that she would meet the person. Subsequently, she realized that a fraud had been committed, affecting several persons and involving individuals posing as high-ranking police officers. The total amount Page No.# 3/3 involved is estimated to exceed ₹2 lakhs. On receipt of the FIR, the police registered Lanka P.S. Case No. 225/2025 under the relevant sections. 4. Mr. K.K. Das, learned APP for the State, submits that the case is still at nascent stage of investigation and that the investigation is ongoing. Considering the substantial amount of money involved in the instant case, bail at this stage cannot be granted. 5. The learned counsel for the accused/applicants submits that nothing has been recovered from the accused/applicants and that they have already spent 39 days in custody; therefore, they should be released on bail. 6. Having heard the learned counsel for both parties and after perusal of materials in heard, this court finds no ground to grant bail to the accused/applicants at this stage. 7.
