29.07.2026 Serial no. 118 [G.S.D] CRM (NDPS) 1539 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with NDPS Case No. 28 of 2025/TR (NDPS) 28 of 2025 arising out of Rajapur PS Case No. 133 of 2025 dated 12.05.2025 u/s 318(2)/318(3)/61(2) of the BNS read with sections 20(b)(ii)(C)/29 of the NDPS Act. -And- In the matter of : Binod Kumar Shaw @ Binod Shaw @ Raki … Petitioner(s) Md. Wasim Akram Ms. S. Parveen … for the Petitioner(s) Mr. Kallol Kr. Basu Mr. Babaswan Mukherjee … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for seven months and there has been no recovery from the present petitioner. Learned advocate emphasizes that the subject-matter of the case relate to alleged recovery of 192 kg of ganja from the other four accused persons. Learned advocate for the State opposes the prayer for bail and submits that there are criminal antecedents of the present petitioner and availability of the call data records connecting the present petitioner with the offence. 2 Having regard to the quantum of seizure and the connection established, I am of the opinion that this is not a fit case for granting bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. However, the learned trial court would take steps for exhausting the process of law in respect of the absconding accused persons; split up the trial and take steps for overcoming the stage of consideration of charges. Accordingly, CRM (NDPS) 1539 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
