1. Affidavit-of-service filed on behalf of petitioner is taken on record. 2. A case is made out in this writ petition that in spite of written complaint lodged with the concerned police authority FIR is not registered prompting the petitioner to approach this Court with the present writ petition. Additional prayer is made for returning key of petitioner’s shop by the concerned police authority as it is contended that key is still lying with the police authority. 3. State respondents are represented by Mr. Billwadal Bhattacharyya, learned Additional Advocate General and private respondents are represented by learned advocates. 4. It is contended on behalf of State respondents that based on the complaint lodged an FIR has been drawn up and criminal prosecution being New Alipore P.S. Case No.122 dated 23rd July, 2026 has been initiated. [2]
5. In view of steps taken by the concerned police authority, it appears that grievance of the petitioner as ventilated in this writ petition is redressed. However, on perusal of the pleadings made in this writ petition and prayers couched, it is not found that any statements are made with regard to key of the shop is lying with the concerned police authority thereby requiring the police authority to return the same. 6. In absence of pleadings and appropriate prayer, contention of petitioner relating to key is not considered. 7. Moreover, it is submitted by learned Additional Advocate General on behalf of State respondents that no key is lying with the concerned police authority. 8. A communication dated 29th July, 2026 of Officer-in- Charge, New Alipore Police Station, Kolkata is placed before this Court and same is taken on record. Copies of the said communication dated 29th July, 2026 are made over to the learned advocates representing petitioner and respondent nos.6 to 8 and 10. 9. Writ petition stands disposed of. 10.
